Terms and Conditions (T&Cs) for Concept Development and Creative Services

1. Scope of Services

Concept development includes the creation of customized creative concepts, including mood boards, style directions, color palettes, and detailed planning ideas that align with the customer's expectations. The service begins after a detailed consultation and initial meeting, which establishes the scope and objectives of the project.

 

2. Conclusion of Contract

A contract between the customer and the service provider is concluded when the customer confirms the offer for the development of a concept in writing. The contract is valid for the scope of services described in the offer. Additional changes or extensions to the project must be agreed upon separately and may incur additional costs.

 

3. Customer's Cooperation Obligations

The customer is obliged to provide all necessary information, materials, and specifications for the concept development in a timely and complete manner. Delays due to incomplete or late information may affect the project timeline. Changes or new requests after the start of concept development are welcome and will be discussed additionally. These changes may lead to an adjustment in the workload, which may be associated with additional costs that will be communicated fairly and transparently.

 

4. Copyright and Usage Rights

All concepts, mood boards, and proposals created are subject to the copyright of the service provider. Upon payment of the agreed fee, the customer receives the right to use the concepts within the framework of the agreed project. Any further use, distribution, or reproduction is only permitted with the written consent of the service provider. The right to use the concepts expires if the payment is not fully made.

 

5. Payment Terms

Payment is made according to the conditions set out in the offer. Typically, a 50% deposit of the total price is due at the start of the project, with the remaining amount payable upon delivery of the final concept. All prices are quoted net, plus applicable VAT. In the event of payment default, the service provider reserves the right to suspend or refuse further services.

 

6. Changes and Revisions

After the first draft of the concept is delivered, up to two rounds of revisions are included to ensure the concept meets the customer's expectations. Should further adjustments or major changes be desired that go beyond the original briefing, these will be discussed individually in consultation. Minor adjustments can be made flexibly at any time and without additional cost to ensure the final result reflects the desired creative vision.

 

7. Liability

The service provider is only liable for damages caused intentionally or by gross negligence. The service provider assumes no liability for the success of the concepts implemented by the customer and the resulting outcomes. The responsibility for the final implementation of the project lies with the customer.

 

8. Cancellation and Withdrawal

The customer may cancel the project at any time, but the cancellation must be made in writing. In the event of cancellation, services already rendered will be invoiced proportionally. If the project is canceled by the customer without good reason after it has begun, the service provider reserves the right to charge a cancellation fee of up to 50% of the agreed total price.

 

9. Confidentiality

The service provider agrees to treat all confidential information and data received in connection with the project as confidential and not to disclose it to third parties unless there is explicit written consent from the customer.

 

10. Final Provisions

Amendments or additions to the contract must be made in writing. If any provision of these T&Cs is invalid, the remaining provisions shall remain unaffected. The law of the country in which the service provider is based applies. The place of jurisdiction is the service provider's place of business.
